Under recent changes to the Copyright Act, educational institutions are
permitted to copy television and radio programs and show them to students
without first obtaining the copyright owner’s authorization.
- Applies to any programs communicated and received in Canada including
American or other broadcasts.
- News and news commentary are treated differently - see below.
- Tariffs of $2 per recorded minute must be paid in most instances.
- Please note that payment of tariffs and any other fees is the
responsibility of the individual department.
- A copy may be kept for up to 12 months after which time it must be
destroyed or erased, or further tariffs will apply.
- The educational institution is required to provide information to
the copyright owner, or a collective representing the owner, about the
making, marking, performing and destruction or erasure of the copy.
- Certification that the copy has been destroyed, i.e. the original form
with signature, must be forwarded to Media Services in the Library, Room
CM35, Notre Dame Campus. Library staff will look after billing and reporting
to the Educational Rights Collective of Canada (ERCC), the agency
responsible under the Act.
Making a Copy
You are permitted to make a single copy of any program broadcast or received
in Canada under the following conditions.
- The copy can only be made at the time the program is aired. Copies of
copies are invalid.
- The copy may be used only on school property for educational purposes.
- The audience must consist primarily of students from the educational
institution.
- The copy can be made and shown for an unlimited number of times during a
period of up to one year from the date the copy is made.
Tariffs For Use of Recorded Copies
The current tariffs appropriate to the College are:
- Seventeen (17) cents per minute (or part thereof) for radio programs.
- Two (2) dollars per minute (or part thereof) for television programs.
Tariffs will be reviewed and revised periodically by the Copyright Board.
News and News Commentary Programs
- A copy of news broadcasts or news commentary programs may be used free
of charge for a period up to one year after the date of recording.
- Documentaries are NOT considered to be
news or news commentaries.
- After one year, the copy must be destroyed or erased, or tariffs must be
paid at the current rates.
- If the copy is retained, tariffs must be paid annually at the
appropriate rate.
All Other Programs
Tariffs apply immediately to the use of copies of all programs other than
news broadcasts or news commentary programs. There is no period of free use.
