Copyright Compliance - Print Materials
Photocopying
Under the provisions of the Canadian Copyright Act, any student or staff
member may make ONE copy in paper form of published print
materials, for educational or research purposes, within certain limits.

Under license from Access Copyright, sufficient copies from Published Works
in their repertoire may be made by the Print and Graphics Centre for
distribution in classes or meetings, or for course packs. (See procedure below)
For excluded works, prior permission must be sought for multiple copies or
course packs. To discover whether works are in Access Copyright’s repertoire, be
sure to check their
Exclusions List.
To copy material in excess of the limits prescribed under the Act, prior
permission must be obtained from the copyright owner. Permission should be in
writing – email is OK – and specify what use is being granted together with any
terms of use or fees.
Please note: The individual granting permission must have
the authority to do so.
Procedure
Requests for multiple copies for distribution or sale must be made on the
form provided by the Print & Graphics Centre. Information required is:
- a full citation for each item to be copied
- Colleague course code or name of group – e.g. ACCT-1234,
College Council
- the number of students or attendees
- a signature attesting that the requested material complies
with copyright limitations
- proof of permission as appropriate
Obligations
Obligation to Cite
Whenever using works protected by copyright , there is an
obligation to cite the source and the name of the author.
Obligation to Restrict Further Use
Whenever copies are distributed, either by sale or in a
class or meeting, each copy MUST include the following statement:
In compliance with the Copyright Act, or with permission
of the copyright owner under license with Access Copyright or other means, this
item is supplied to you solely for purposes of private study, research,
review, criticism, or news reporting. No further copying, including scanning,
faxing, or transmitting this item is permitted without a proper license or the
express consent of the copyright owner.
Limits
- No copying may exceed 10 per cent of a Published
Work, other than a textbook (see below), or the
following, whichever is greater:
- an entire chapter from a book provided that
it does not exceed 20 per cent of the book;
- an entire article from a
periodical publication;
- an entire short story,
play, poem or essay from a book
or periodical publication;
- an entire entry from an
encyclopedia, dictionary,
annotated bibliography or
similar reference book;
- an entire reproduction of an
artistic work from a book or
periodical publication; and
- a single musical score from
a book or periodical
publication.
- No copying may exceed 5 per cent of a textbook
produced primarily for the post secondary education market, or
the following, whichever is greater:
- an entire chapter from a textbook provided
that it does not exceed 10 per cent of the
textbook;
- an entire short story, play, poem or essay
from the textbook provided that it does not
exceed 10 per cent of the textbook; and
- an entire reproduction of an artistic work
or a single musical score from the textbook
provided that it does not exceed 10 per cent of
the textbook.
- Notwithstanding the above,
no copies may be made of the following:
- any of the works referred to above where the
publication containing the work does not contain
other works. For example, no copy may be made of
a play from a publication containing the play
but no other work;
- unpublished works
- proprietary workbooks, work cards,
assignment sheets, tests and examination papers;
- instruction manuals;
- newsletters with circulation intended to be
restricted to a fee-paying clientele; or
- business cases available for purchase.
NOTE: Agreements with publishers
trump the Copyright Act. Get permissions in writing – email is OK.
